2025 Minimum Consumer Prices for Collectables
Pricing Policy for Heart by Goodwill, Mark Roberts, Katherine's Collection
As a designer, manufacturer and importer-wholesaler of premium seasonal decoration, Goodwill annually deploys its best talent to design and manufacture beautiful new designs every year in the unique Heart by Goodwill collection. American brands Mark Roberts and Katherine's Collection also bring beautiful lines of original designs every year.
These brands are all pre-eminent opportunities for retailers to differentiate and profile themselves in a higher segment and appeal to consumers seeking or collecting luxury items.
Under no circumstances is it our intention to use these brands and products in promotional and discount campaigns, which would detract from the image of those brands. It is also our desire that there is a level playing field between retailers in terms of pricing for these brands. Rather than playing on price, we encourage retailers to stand out in terms of presentation at the point of sale or online, in terms of original decoration, in terms of realising unique projects and in terms of customer service - in other words, everything that attracts a high-end customer to a retailer!
In recent years, we have already made comments to retailers not to use these Collectables, to spark a price war. For 2025, we now want to officialise this with Minimum Consumer Prices.
GOODWILL PRICING POLICY
1. This Goodwill Pricing Policy with Minimum Consumer Prices will be in effect from 1 January 2025, for all new products in the Heart by Goodwill line, the Katherines Collection products for Spring, Halloween and Christmas 2025 and the Mark Roberts lines for Spring, Halloween and Christmas 2025.
2. The Goodwill Pricing Policy will be in force each time for the new products of the current calendar year.
3. Specifically, we ask all retailers, both physical and online retailers to adopt the following Minimum Consumer Prices even if they sell through social media or any online platforms :
3.1 All Collection Items with wholesale price of EUR 300 or less (excluding VAT), will be sold at a Consumer Price including VAT, which is at least x2.2 of this wholesale price excluding VAT and excluding discounts.
For example: an item has wholesale price excluding VAT of EUR 100, then the Minimum Consumer Price is EUR 220 including VAT.
3.2 All Collection Items with wholesale price over EUR 300 (excluding VAT), will be sold at a Consumer Price including VAT, which is at least x2.0 of this wholesale price excluding VAT and excluding discounts.
For example: an item has wholesale price excluding VAT of EUR 499, then the Minimum Consumer Price is EUR 998 including VAT.
4. If a retailer receives a discount, e.g. 2% for proforma payment, or for any other reason, this does not affect the Minimum Consumer Price. That should still be calculated on the wholesale price without discount.
5. Retailers may do promotions or give discounts, as long as they respect the Minimum Consumer Price. For example, they may sell at x2.5 and discount for an open door day, as long as they stay above factor x2.2 (or x2.0 for items with wholesale price above EUR 300).
6. Also in case of tying of the affected articles, the retailer must respect the Minimum Consumer Price for the whole of the affected articles. However, it is possible to offer discounts on other brands or non-collection Items in a tied sale.
7. If for any reason, Goodwill should adjust its prices upwards during a calendar year, retailers should adjust the Minimum Consumer Prices upwards.
8. If retailers estimate, based on their local market situation, their experience, etc. that they can sell Collectables at higher prices, they are absolutely free to do so - Goodwill does not impose any restrictions to the upside. On the contrary, a premium location, better customer service, etc. also justify higher margins for the retailer.
9. If retailers sell Collectables on platforms such as amazon.com, bol.com, ebay or others, they should make this known to Goodwill via info@goodwill.be or welcome@goodwill.be
10. Some exceptions to this pricing policy concern:
- Older articles or articles discounted by Goodwill, i.e. these are always articles from previous collections that are no longer in production.
- 10 days before the end of the Season, i.e. 10 days before Christmas, 10 days before Easter or 10 days before Halloween, it is permitted to deviate from the Pricing Policy with discounts to a limited extent.
11. Goodwill reserves the right to adjust this Pricing Policy at any time.
NON-RESPECT FOR GOODWILL PRICING POLICY
1. If a retailer either physically in a retail outlet or online, fails to comply with the rules of the Goodwill Pricing Policy, they will receive a notice from Goodwill accordingly.
2. The retailer will be given the opportunity within 48h of the notice, to adjust its posted prices to comply with the rules.
3. If the retailer still fails to adjust or bring its prices in line with the above rules within this 48h period, Goodwill reserves the right, to suspend or stop selling products to this retailer.
4. Upon establishing repeated breaches, Goodwill will immediately stop all commercial transactions with the retailer, without notice.
